Terms and Conditions for use of this Website

  

 

  1. Any use of you by this website animacwedding.co.uk (the ‘Website’) shall be governed by these terms and conditions of use (the ‘TCU’).

  2. AniMac Wedding  (‘AniMac’) reserves the right to amend these TCU at any time by posting an amended version of such TCU n the Website.

  3. You warrant to AniMac that, by using the Website, you are not in breach of and will not act in such a way as to breach any law or order of court or other restriction and hereby agree to indemnify AniMac against all liability arising from such a breach of this provision.

  4. You undertaken not to upload onto the Website (i) any incorrect or untrue information as to your own identity, or (ii) any images, text, links, codes or other content that breaches the rights of others or reasonable standards of morality and decency or which in any way breach the laws of the United Kingdom, or (iii) either knowingly or inadvertently, any virus, Trojan, autobot, or other form of malware of any description.  You furthermore agree and undertake to indemnify AniMac against all liability arising from such a breach of this provision.

  5. AniMac reserves the right to remove at any time and without notice to you, any content uploaded by you to the Website.

  6. Should you access any part of the Website by means of personal login, password or code (a ‘Username’) you accept full responsibility and liability for access made to the Website and actions taken under your Username, whether or not you were the person who made such access or took such actions.

  7. AniMac shall not be liable to you for any loss or damage, either directly or indirectly arising from your visit to or use of the Website, including, but not limited to, the linking of this Website to other websites or the unauthorised corruption or infiltration of the Website by third parties.

  8. AniMac reserves the right to suspend or terminate your use of the Website at any time in its absolute discretion.

  9. The Website shall be maintained in accordance with the Privacy Policies published by AniMac on the Website from time to time.

  10. You acknowledge that AniMac or its contractual partners own the intellectual property rights in the content of the Website and all trademarks contained therein and you undertake not to, directly or indirectly, do anything to infringe upon those rights, including, but not limited to the reproduction or copying of any part of the Website or any content thereof.

  11. When purchasing any product from this Website you agree to do so in accordance with the Terms and Conditions of Sale published by AniMac on the Website at the time or purchase, and that such Terms and Conditions of Sale will regulate such purchase.

  12. In the event of any provision of these TCU being held to be invalid, void or unenforceable by a court of competent authority, that condition shall be deemed severable and the remainder of these TCU shall remain valid and enforceable.

  13. The laws of Scotland shall govern these TCU and you agree to submit to the exclusive jurisdiction of the Scottish courts for the resolution of any claim or dispute arising from your use of the Website and or the provisions of the TCU.

  14. All written notices to be given to AniMac shall be sent to the contact address stated in the Privacy Policies published by AniMac on the Website or as supplied upon enquiry.

 

 

 

Terms and Conditions for Sale of Goods

 

 

  1. Any sale of products or goods by AniMac Wedding (‘AniMac’) to you shall be governed by these Terms and Conditions of Sale (‘T&C’) and you hereby agree to be bound by the T&C in respect thereof.

  2. Any orders placed by you on our Website animacwedding.co.uk (the ‘Website’) to purchase one of the products listed or displayed on the Website will represent an offer by you to purchase that product.  Upon receipt of your order, AniMac, through the website or otherwise, will send you email confirmation of receipt of your order and its ability to fulfil that order (the ‘Email Confirmation’).  Sending the Email Confirmation will constitute AniMac’s acceptance of your offer to purchase the ordered products.  In the event that, for whatever reason, AniMac cannot accept your offer to purchase products listed or displayed on the Website, AniMac will send you, through the website or otherwise, an email rejecting your order.

  3. Full payment for any goods purchased from AniMac is required prior to their dispatch.

  4. In the case of the purchase of a number of invitations or related products for a wedding, christening, engagement, party or other event or occasion (‘Invitations’) an initial non-refundable deposit of 50% of the total cost ('Deposit') shall be paid to AniMac whereupon a sample pack of up to four Invitations will be provided.  Thereafter prior to dispatch of the Invitations the outstanding balance of the sale price of the Invitations must be received by AniMac, being the sale price of the Invitations, less the Deposit.

  5. Products listed or displayed on the Website are limited in stock, are handmade and often made to order.  As such the product received by you may vary slightly in style or dimension from that listed or displayed on the Website.  Furthermore, AniMac reserves the right to alter, reassess or vary the use of raw materials used in the creation of its products should they become subject to restricted availability or cost prohibitive.

  6. Except by special arrangement, AniMac only supplies products for sale and delivery within the territory of the United Kingdom.

  7. All reasonable delivery or postal costs relating to the purchase of any products by you from the Website shall be the responsibility of AniMac.  Any postal or delivery costs in relation to the sending of Invitations to individual recipients shall not be the responsibility of AniMac who shall be responsible only to ensure initial delivery of the Invitations to you, the Purchaser.

  8. Any products ordered by you on the Website may be cancelled without penalty by you until such time as AniMac has sent Email Confirmation in respect of such order.  Any cancellation of products ordered after dispatch by AniMac of an Email Confirmation shall incur a cancellation fee equal to the full purchase price of the products ordered.

  9. In the case of Invitations, any cancellation of an order after despatch of Email Confirmation or otherwise confirmed in writing to you by AniMac shall incur a cancellation fee equal to the sum of the Sample Deposit and the First Instalment.  

  10. In the event of any goods or products supplied to you by AniMac being damaged, defective of incorrect, you may return those items to AniMac within 14 days, whereupon replacement items will be dispatched.  AniMac is unable to exchange items which are not damaged, defective or incorrect.

  11. AniMac accepts payments via PayPal on the Website or by cash or cheque in person or by cheque via post.

  12. You consent to receive communications from us electronically either by email or by posting notices on the Website and any such communications shall serve as written notice.  In the event of your enquiring to contact AniMac by non-electronic means, you may do so at the contact address stated in the Privacy Policies published by AniMac on the Website or as supplied on enquiry.

  13. AniMac shall only be responsible for direct foreseeable losses to you caused by AniMac’s breach of the T&C up to a total value of the purchase price of the goods ordered and specifically AniMac shall not be liable to any business, indirect or consequential loss suffered by you.  AniMac will not be responsible to you for any breach of the T&C arising from any event or other reason beyond its control.

  14. In the event of any provision of the T&C being held to be invalid, void or unenforceable by a court of competent authority, that condition shall be deemed severable and the remainder of these T&C shall remain valid and enforceable.
